User Agreement (Public Offer)

1. Terms and Definitions

1. 1.1. Service — a web application/website available at https://whosecar.by/, providing the technical ability to search for a vehicle by state registration plate and contact its owner via a Telegram bot.
2. 1.2. Operator — Yegor Usik, a natural person applying a special taxation regime (self-employed), registered in the Republic of Belarus, managing the Service.
3. 1.3. User — a natural person who has registered/authorized in the Service via Telegram.
4. 1.4. Vehicle Owner — a User who has added vehicle information (state registration plate) to the Service and confirmed that they are its owner or lawful user.
5. 1.5. Searcher — a User searching for a vehicle by state registration plate for the purpose of sending a quick message.
6. 1.6. Quick Message — a pre-defined text set by the Operator, sent via the Telegram bot to the Vehicle Owner at the initiative of the Searcher.
7. 1.7. User Page — a personal page in the Service, access to which may be restricted by the User's settings.

2. Subject of the Agreement

1. 2.1. The Operator grants the User access to the Service functionality under the terms of this Agreement.
2. 2.2. The Service is not an ad aggregator, a vehicle sale platform, a dating service, or a mass communication medium. The Service performs an exclusively technical function: it ensures the transmission of a pre-defined message from one User to another via the Telegram bot.
3. 2.3. The Operator does not verify and does not guarantee the accuracy of information provided by Users (including state registration plates, photos, names, contact details). All responsibility for the accuracy of the added information lies with the User who added it.
4. 2.4. Acceptance of this Agreement is the User's completion of registration/authorization via Telegram and the start of using the Service.

3. Registration and Authorization

1. 3.1. Access to the Service functionality (adding a vehicle, search, sending messages, viewing user pages) is provided only to registered Users.
2. 3.2. Registration is carried out via the Telegram widget. The User confirms that the Telegram account used for registration belongs to them personally.
3. 3.3. The User undertakes not to transfer access to their Telegram account to third parties. All actions performed using the User's account are deemed to be performed by the User.
4. 3.4. Age restriction. The User confirms that they have reached the age of 18. Registration of persons under 18 is not permitted. If the Operator becomes aware of the registration of a minor, the account may be blocked and the data deleted.

4. Service Functionality

1. 4.1. Adding a vehicle. The User has the right to add vehicle information (state registration plate). By adding a vehicle, the User confirms that they are its owner or lawful user and have the right to dispose of information about it.
2. 4.2. Search. The Searcher enters the state registration plate into a special form. If such a vehicle has been added to the Service, the Searcher is given the opportunity to send one of the pre-defined quick messages.
3. 4.3. Communication via the bot. Communication is carried out exclusively via the Telegram bot. The Operator does not transfer personal data of the sender and recipient to each other (Telegram ID, name, phone number). The parties see only the state registration plate to which the message relates.
4. 4.4. User Page. The User has the right to fill in additional fields (Telegram profile photo, name, phone number, Instagram link). All fields are optional. The User independently determines which fields to display on their page and which to hide. Hidden fields are not displayed (or a placeholder is shown, e.g., «Name hidden»).
5. 4.5. The Operator has the right to change the functionality, add or remove certain features of the Service without prior notice.

5. Rules of Use

The User undertakes not to:

1. 5.1. Use the Service for spam, mass mailing, advertising, insults, threats, fraud, or any actions violating the legislation of the Republic of Belarus.
2. 5.2. Add vehicles that do not belong to them and over which they have no lawful rights of management/disposal.
3. 5.3. Attempt to deanonymize Users who have hidden their data, or circumvent privacy settings.
4. 5.4. Carry out automated data collection (parsing) of the Service, create load disrupting the normal functioning of the Service, or attempt unauthorized access to the database.
5. 5.5. Use the Service for stalking, intimidation, or causing harm to other persons.

6. Liability

1. 6.1. The Service is provided on an «as is» basis. The Operator does not guarantee uninterrupted operation of the Service, the absence of errors, or that the Vehicle Owner will respond to a message or that the specified vehicle actually exists.
2. 6.2. The Operator is not liable for:

• actions of Users, including inaccurate indication of vehicle information;
• blocking of the User's Telegram account for reasons beyond the Operator's control;
• the content of quick messages (since they are pre-defined by the Operator but sent at the initiative of the User);
• any losses arising from the use or inability to use the Service.

6.3. A User who violates this Agreement is liable in accordance with the legislation of the Republic of Belarus. The Operator has the right to block the violator's account and delete related data.

7. Intellectual Property

1. 7.1. All elements of the Service (design, code, texts, message templates, logos) are the property of the Operator or are used on lawful grounds. Copying, reproduction, or distribution of the Service elements without the Operator's permission is prohibited.

8. Amendments to the Agreement

1. 8.1. The Operator has the right to amend this Agreement. The new version comes into force upon its publication on the Website. Continued use of the Service after amendments means the User's consent to the new version.

9. Dispute Resolution

1. 9.1. All disputes are resolved through negotiations. If no agreement is reached — in court in accordance with the legislation of the Republic of Belarus.
